Today February 22 2010 is the day that a verdict in Kamloops Court is to come down for the 2008 triple murder of three children in their home in Merritt. David Allan Schoenborn will be found guilty of 1st degree murder and face at least the minimum sentencing requirement which is determined in part for the protection of the public, or be found not mentally fit at the time of the crime. Update : The CBC is reporting that there was a verdict of not criminally responsable. Meaning that when the murder happened the accused was delusional and did not understand right from wrong. This according to a judge is on a balance of probabilities a less strict standard then reasonable doubt required for criminal conviction.
We regret this as we believe that the presumptions need always to go to the innocents.. as it did in the Latimer case in Saskatchewan, we hope for an appeal by the crown after a mental review board s findings are published.
